判決書指出，有強盜前科的吳男透過友人介紹結識少女，2018年7月11日吳男邀約朋友以及少女一同前往釣蝦場唱歌飲酒。然而，少女不勝酒力醉倒，吳男主動表示要載她回家，沒想到卻是載回自己家性侵2次得逞。

期間少女曾下體疼痛醒來，但因太醉無法抵抗，哭著求吳男載其返家，隨後又繼續昏睡，直到隔日友人詢問為何沒直接返家，她才回答因為擔心回家挨罵，便被載到吳男家休息，不確定有沒有發生關係，而事後她越想越不對，認為自己遭到性侵，便赴醫院驗傷後提告。

法院審理時，吳男坦承與少女發生關係，但她全程清醒也未反抗，並沒有性侵對方，而法官進一步調查後，發現少女在事發後仍持續與吳男連繫，還傳「好，很棒恭喜」、「好想吐」、「昨天的份沒吐完（笑哭圖案）」、「哪有我才吃兩片pizza」、「你的肚子出賣你了」、「好好笑」、「快去洗啦」等訊息。

法官事後認為，少女的反應明顯與一般遭性侵的被害人，在受害後身心俱創，難以再與加害人聯絡、接觸的反應相反，此外，少女也未提出積極的證據證明自己是遭到性侵，因此將吳男以對14歲以上未滿16歲女子為性交罪判處5個月有期徒刑，且可易服社會勞動。全案可上訴。
